ਕੈਨੇਡਾ ਵੱਲੋਂ ਨਾਗਰਿਕਤਾ ਕਾਨੂੰਨਾਂ ਵਿੱਚ ਅਹਿਮ ਬਦਲਾਅ!
ਕੈਨੇਡਾ ਨੇ ਆਪਣੇ ਨਾਗਰਿਕਤਾ ਕਾਨੂੰਨਾਂ ਨੂੰ ਆਧੁਨਿਕ ਬਣਾਉਣ ਲਈ ਕਦਮ ਚੁੱਕੇ ਹਨ, ਜਿਸ ਨਾਲ ਉਨ੍ਹਾਂ ਲੋਕਾਂ ਨੂੰ ਇੱਕ ਨਿਰਪੱਖ ਅਤੇ ਆਸਾਨ ਤਰੀਕਾ ਮਿਲੇਗਾ, ਜੋ ਪੁਰਾਣੇ ਨਿਯਮਾਂ ਕਾਰਨ ਆਪਣੇ ਵਿਦੇਸ਼ ਵਿੱਚ ਪੈਦਾ ਹੋਏ ਜਾਂ ਗੋਦ ਲਏ ਗਏ ਬੱਚਿਆਂ ਨੂੰ ਕੈਨੇਡੀਅਨ ਨਾਗਰਿਕਤਾ ਨਹੀਂ ਦੇ ਸਕੇ ਸਨ। ਬਿੱਲ C-3, ਸਿਟੀਜ਼ਨਸ਼ਿਪ ਐਕਟ (2025) ਵਿੱਚ ਸੋਧ ਕਰਨ ਵਾਲੇ ਕਾਨੂੰਨ ਨੂੰ ਹਾਲ ਹੀ ਵਿੱਚ ਸ਼ਾਹੀ ਮਨਜ਼ੂਰੀ ਮਿਲ ਗਈ ਹੈ। ਇਸ ਫੈਸਲੇ ਦਾ ਲਾਭ ਕੈਨੇਡਾ ਵਿੱਚ ਵੱਸਦੇ ਹਜ਼ਾਰਾਂ ਭਾਰਤੀ ਮੂਲ ਦੇ ਪਰਿਵਾਰਾਂ ਨੂੰ ਹੋਣ ਦੀ ਸੰਭਾਵਨਾ ਹੈ। ਕੈਨੇਡਾ ਦੀ ਇਮੀਗ੍ਰੇਸ਼ਨ ਮੰਤਰੀ, ਲੀਨਾ ਮੇਟਲੇਜ ਡਾਇਬ ਨੇ ਕਿਹਾ ਕਿ ਇਹ ਬਿੱਲ ਦੇਸ਼ ਦੇ ਨਾਗਰਿਕਤਾ ਕਾਨੂੰਨਾਂ ਵਿੱਚ ਲੰਬੇ ਸਮੇਂ ਤੋਂ ਚੱਲ ਰਹੀਆਂ ਸਮੱਸਿਆਵਾਂ ਨੂੰ ਹੱਲ ਕਰੇਗਾ ਅਤੇ ਵਿਦੇਸ਼ਾਂ ਵਿੱਚ ਪੈਦਾ ਹੋਏ ਜਾਂ ਗੋਦ ਲਏ ਬੱਚਿਆਂ ਵਾਲੇ ਪਰਿਵਾਰਾਂ ਲਈ ਨਿਰਪੱਖਤਾ ਲਿਆਵੇਗਾ। ਇਹ ਉਨ੍ਹਾਂ ਲੋਕਾਂ ਨੂੰ ਨਾਗਰਿਕਤਾ ਪ੍ਰਦਾਨ ਕਰੇਗਾ, ਜਿਨ੍ਹਾਂ ਨੂੰ ਪਿਛਲੇ ਕਾਨੂੰਨਾਂ ਦੁਆਰਾ ਬਾਹਰ ਰੱਖਿਆ ਗਿਆ ਸੀ, ਅਤੇ ਇਹ ਭਵਿੱਖ ਲਈ ਸਪੱਸ਼ਟ ਨਿਯਮ ਤੈਅ ਕਰੇਗਾ, ਜੋ ਅਜੋਕੇ ਪਰਿਵਾਰਾਂ ਦੇ ਰਹਿਣ-ਸਹਿਣ ਨੂੰ ਦਰਸਾਉਂਦੇ ਹਨ। ਡਾਇਬ ਨੇ ਇੱਕ ਬਿਆਨ ਵਿੱਚ ਕਿਹਾ ਕਿ ਇਹ ਤਬਦੀਲੀਆਂ ਕੈਨੇਡੀਅਨ ਨਾਗਰਿਕਤਾ ਨੂੰ ਮਜ਼ਬੂਤ ਅਤੇ ਸੁਰੱਖਿਅਤ ਕਰਨਗੀਆਂ। ਇਹ ਕਾਨੂੰਨ ਹਾਲੇ ਪ੍ਰਭਾਵੀ ਨਹੀਂ ਹੋਇਆ ਹੈ। ਲਿਬਰਲ ਸਰਕਾਰ ਨੂੰ ਅਜੇ ਇਸਦੀ ਸ਼ੁਰੂਆਤੀ ਮਿਤੀ ਤੈਅ ਕਰਨੀ ਪਵੇਗੀ, ਪਰ ਸ਼ਾਹੀ ਮਨਜ਼ੂਰੀ ਮਿਲਣਾ ਇਹ ਦਰਸਾਉਂਦਾ ਹੈ ਕਿ ਓਟਵਾ ਇਸ ਨੂੰ ਜਲਦੀ ਅੱਗੇ ਵਧਾਉਣ ਦੀ ਯੋਜਨਾ ਬਣਾ ਰਿਹਾ ਹੈ।
ਇਸ ਤੋਂ ਪਹਿਲਾਂ 2009 ਵਿੱਚ, ਸੰਘੀ ਸਰਕਾਰ ਨੇ ਕਾਨੂੰਨ ਬਦਲ ਦਿੱਤਾ ਸੀ ਤਾਂ ਜੋ ਵਿਦੇਸ਼ਾਂ ਵਿੱਚ ਪੈਦਾ ਹੋਏ ਕੈਨੇਡੀਅਨ ਆਪਣੀ ਨਾਗਰਿਕਤਾ ਸਿਰਫ਼ ਤਾਂ ਹੀ ਅੱਗੇ ਦੇ ਸਕਣ, ਜੇਕਰ ਉਨ੍ਹਾਂ ਦਾ ਬੱਚਾ ਕੈਨੇਡਾ ਵਿੱਚ ਪੈਦਾ ਹੋਇਆ ਹੋਵੇ। ਹਾਲਾਂਕਿ, ਦਸੰਬਰ 2023 ਵਿੱਚ ਓਨਟਾਰੀਓ ਸੁਪੀਰੀਅਰ ਕੋਰਟ ਨੇ ਇਸਨੂੰ ਗੈਰ-ਸੰਵਿਧਾਨਕ ਮੰਨਿਆ ਸੀ। ਇਸ ਕਾਨੂੰਨ ਨੇ “ਲੌਸਟ ਕੈਨੇਡੀਅਨਾਂ” ਦੀ ਇੱਕ ਸ਼੍ਰੇਣੀ ਬਣਾਈ, ਭਾਵ ਉਹ ਲੋਕ ਜੋ ਸੋਚਦੇ ਸਨ ਕਿ ਉਹ ਨਾਗਰਿਕਤਾ ਦੇ ਯੋਗ ਹਨ ਪਰ ਪੁਰਾਣੇ ਕਾਨੂੰਨਾਂ ਕਾਰਨ ਬਾਹਰ ਰਹਿ ਗਏ ਸਨ। “ਸੈਕਿੰਡ-ਜਨਰੇਸ਼ਨ ਕੱਟ-ਆਫ” ਨਿਯਮ ਦੇ ਤਹਿਤ, ਕੈਨੇਡਾ ਤੋਂ ਬਾਹਰ ਪੈਦਾ ਹੋਏ ਬੱਚੇ ਕੈਨੇਡੀਅਨ ਨਾਗਰਿਕਤਾ ਪ੍ਰਾਪਤ ਨਹੀਂ ਕਰ ਸਕਦੇ ਸਨ, ਜੇਕਰ ਉਨ੍ਹਾਂ ਦੇ ਕੈਨੇਡੀਅਨ ਮਾਪੇ ਵੀ ਵਿਦੇਸ਼ ਵਿੱਚ ਪੈਦਾ ਹੋਏ ਸਨ। ਇਸ ਨਿਯਮ ਨੇ ਬਹੁਤ ਸਾਰੇ ਭਾਰਤੀ ਮੂਲ ਦੇ ਕੈਨੇਡੀਅਨਾਂ ਲਈ ਮੁਸ਼ਕਲਾਂ ਖੜ੍ਹੀਆਂ ਕੀਤੀਆਂ। ਨਵੀਆਂ ਸੋਧਾਂ ਦੇ ਨਾਲ, ਵਿਦੇਸ਼ਾਂ ਵਿੱਚ ਪੈਦਾ ਹੋਏ ਕੈਨੇਡੀਅਨ ਮਾਪਿਆਂ ਦੇ ਬੱਚੇ ਵੰਸ਼ ਦੁਆਰਾ ਨਾਗਰਿਕਤਾ ਪ੍ਰਾਪਤ ਕਰ ਸਕਦੇ ਹਨ, ਬਸ਼ਰਤੇ ਉਨ੍ਹਾਂ ਦੇ ਮਾਪਿਆਂ ਦਾ ਕੈਨੇਡਾ ਨਾਲ “ਮਜ਼ਬੂਤ ਸਬੰਧ” ਹੋਵੇ। ਮਾਪਿਆਂ ਨੂੰ ਇਹ ਦਿਖਾਉਣਾ ਹੋਵੇਗਾ ਕਿ ਉਹ ਬੱਚੇ ਦੇ ਜਨਮ ਜਾਂ ਗੋਦ ਲੈਣ ਤੋਂ ਪਹਿਲਾਂ ਘੱਟੋ-ਘੱਟ 1,095 ਦਿਨ ਜਾਂ ਤਿੰਨ ਸਾਲ ਸਰੀਰਕ ਤੌਰ ‘ਤੇ ਕੈਨੇਡਾ ਵਿੱਚ ਰਹੇ ਹਨ। ਇਹ ਸੋਧ ਕੈਨੇਡੀਅਨ ਪਛਾਣ ਨੂੰ ਮਾਨਤਾ ਦਿੰਦੀ ਹੈ ਅਤੇ ਇਹ ਯਕੀਨੀ ਬਣਾਉਂਦੀ ਹੈ ਕਿ ਮਾਪੇ ਆਪਣੀ ਨਾਗਰਿਕਤਾ ਆਪਣੇ ਬੱਚਿਆਂ ਨੂੰ ਦੇ ਸਕਣ, ਭਾਵੇਂ ਉਹ ਕਿਤੇ ਵੀ ਪੈਦਾ ਹੋਏ ਹੋਣ। ਇਹ ਕਾਨੂੰਨ ਹੁਣ ਕੈਬਨਿਟ ਦੇ ਹੁਕਮ ਦੀ ਉਡੀਕ ਕਰ ਰਿਹਾ ਹੈ ਤਾਂ ਜੋ ਇਸਨੂੰ ਲਾਗੂ ਕਰਨ ਦੀ ਮਿਤੀ ਤੈਅ ਕੀਤੀ ਜਾ ਸਕੇ। ਅਦਾਲਤ ਨੇ ਪਹਿਲਾਂ ਹੀ ਇਸਨੂੰ ਲਾਗੂ ਕਰਨ ਦੀ ਅੰਤਿਮ ਮਿਤੀ ਜਨਵਰੀ 2026 ਤੱਕ ਵਧਾ ਦਿੱਤੀ ਹੈ, ਤਾਂ ਜੋ ਇਮੀਗ੍ਰੇਸ਼ਨ ਵਿਭਾਗ ਪ੍ਰਕਿਰਿਆ ਨੂੰ ਪੂਰਾ ਕਰ ਸਕੇ।
