ਡੈਸਕ- ਪੰਜਾਬ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਵੱਲੋਂ ਸ਼ੰਭੂ ਬਾਰਡਰ ਖੋਲ੍ਹਣ ਦੇ ਫੈਸਲੇ ਖਿਲਾਫ ਹਰਿਆਣਾ ਸਰਕਾਰ ਨੇ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕੀਤੀ ਹੈ। 10 ਜੁਲਾਈ ਨੂੰ ਇੱਕ ਜਨਹਿੱਤ ਪਟੀਸ਼ਨ ‘ਤੇ ਸੁਣਵਾਈ ਕਰਦਿਆਂ ਪੰਜਾਬ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਨੇ ਹਰਿਆਣਾ ਸਰਕਾਰ ਨੂੰ ਇੱਕ ਹਫ਼ਤੇ ਦੇ ਅੰਦਰ ਸ਼ੰਭੂ ਬਾਰਡਰ ਦੇ ਬੈਰੀਕੇਡ ਖੋਲ੍ਹਣ ਦੇ ਨਿਰਦੇਸ਼ ਦਿੱਤੇ ਸਨ। ਇਸ ਹੁਕਮ ਵਿਰੁੱਧ ਦਾਇਰ ਪਟੀਸ਼ਨ ਵਿੱਚ ਹਰਿਆਣਾ ਸਰਕਾਰ ਦਾ ਕਹਿਣਾ ਹੈ ਕਿ ਉਸ ਨੇ ਅਮਨ-ਕਾਨੂੰਨ ਬਹਾਲ ਕਰਨ ਲਈ ਸੜਕ ਨੂੰ ਬੰਦ ਰੱਖਿਆ ਹੈ। ਹਾਈ ਕੋਰਟ ਨੂੰ ਅਜਿਹਾ ਹੁਕਮ ਨਹੀਂ ਦੇਣਾ ਚਾਹੀਦਾ।
ਮੰਨਿਆ ਜਾ ਰਿਹਾ ਹੈ ਕਿ ਸੋਮਵਾਰ ਨੂੰ ਹਰਿਆਣਾ ਸਰਕਾਰ ਸੁਪਰੀਮ ਕੋਰਟ ਤੋਂ ਇਸ ਪਟੀਸ਼ਨ ‘ਤੇ ਜਲਦੀ ਸੁਣਵਾਈ ਦੀ ਮੰਗ ਕਰ ਸਕਦੀ ਹੈ। ਦੱਸ ਦੇਈਏ ਕਿ ਸ਼ੰਭੂ ਬਾਰਡਰ ਨੂੰ ਬੰਦ ਕਰਨ ਨੂੰ ਲੈ ਕੇ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਵੀ ਸਖ਼ਤ ਟਿੱਪਣੀ ਕੀਤੀ ਸੀ। ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਹਰਿਆਣਾ ਸਰਕਾਰ ਨੂੰ ਫਟਕਾਰ ਲਗਾਉਂਦੇ ਹੋਏ ਕਿਹਾ ਕਿ ਕੋਈ ਵੀ ਸਰਕਾਰ ਹਾਈਵੇਅ ਨੂੰ ਕਿਵੇਂ ਰੋਕ ਸਕਦੀ ਹੈ। ਸਰਕਾਰ ਦਾ ਕੰਮ ਆਵਾਜਾਈ ਨੂੰ ਨਿਯਮਤ ਕਰਨਾ ਹੈ। ਉਸ ਦਾ ਕੰਮ ਹਾਈਵੇ ਬੰਦ ਕਰਨਾ ਨਹੀਂ ਹੈ।
ਕੀ ਹੈ ਮਾਮਲਾ?
ਦਰਅਸਲ, ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਸ਼ੰਭੂ ਬਾਰਡਰ ਖੋਲ੍ਹਣ ਦੇ ਹੁਕਮ ਦਿੱਤੇ ਹਨ। ਪਿਛਲੇ ਛੇ ਮਹੀਨਿਆਂ ਤੋਂ ਕਿਸਾਨ ਦਿੱਲੀ ਵੱਲ ਮਾਰਚ ਕਰਨ ਲਈ ਇੱਥੇ ਫਸੇ ਹੋਏ ਹਨ। ਬਾਰਡਰ ਬੰਦ ਹੋਣ ਕਾਰਨ ਆ ਰਹੀਆਂ ਦਿੱਕਤਾਂ ਨੂੰ ਲੈ ਕੇ ਸਥਾਨਕ ਵਪਾਰੀਆਂ ਨੇ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕੀਤੀ ਸੀ, ਜਿਸ ਵਿੱਚ ਉਨ੍ਹਾਂ ਨੇ ਸ਼ੰਭੂ ਬਾਰਡਰ ਖੋਲ੍ਹਣ ਦੀ ਮੰਗ ਕੀਤੀ ਸੀ। ਸ਼ੰਭੂ ਬਾਰਡਰ ਖੋਲ੍ਹਣ ਦੇ ਪੰਜਾਬ ਤੇ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਦੇ ਹੁਕਮਾਂ ‘ਤੇ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਵੱਡੀ ਟਿੱਪਣੀ ਕਰਦਿਆਂ ਹਰਿਆਣਾ ਸਰਕਾਰ ਨੂੰ ਸਵਾਲ ਵੀ ਪੁੱਛੇ ਹਨ।
ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਕੀ ਕਿਹਾ?
ਅਦਾਲਤ ਨੇ ਹਰਿਆਣਾ ਸਰਕਾਰ ਨੂੰ ਫਟਕਾਰ ਲਗਾਉਂਦੇ ਹੋਏ ਕਿਹਾ ਕਿ ਸੂਬਾ ਸਰਕਾਰ ਬਾਰਡਰ ਖੋਲ੍ਹਣ ਦੇ ਹਾਈ ਕੋਰਟ ਦੇ ਹੁਕਮਾਂ ਨੂੰ ਕਿਉਂ ਚੁਣੌਤੀ ਦੇਣਾ ਚਾਹੁੰਦੀ ਹੈ। ਕਿਸਾਨ ਨਾਗਰਿਕ ਹਨ, ਉਨ੍ਹਾਂ ਨੂੰ ਭੋਜਨ ਅਤੇ ਚੰਗੀਆਂ ਡਾਕਟਰੀ ਸਹੂਲਤਾਂ ਮੁਹੱਈਆ ਕਰਵਾਈਆਂ ਜਾਣੀਆਂ ਚਾਹੀਦੀਆਂ ਹਨ। ਉਹ ਆਉਣਗੇ, ਨਾਅਰੇਬਾਜ਼ੀ ਕਰਨਗੇ ਅਤੇ ਵਾਪਸ ਚਲੇ ਜਾਣਗੇ। ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਰਾਜ ਸਰਕਾਰ ਹਾਈਵੇਅ ‘ਤੇ ਆਵਾਜਾਈ ਨੂੰ ਕਿਵੇਂ ਰੋਕ ਸਕਦੀ ਹੈ। ਟਰੈਫਿਕ ਨੂੰ ਕੰਟਰੋਲ ਕਰਨਾ ਸਰਕਾਰ ਦਾ ਕੰਮ ਹੈ। ਅਸੀਂ ਕਹਿੰਦੇ ਹਾਂ ਕਿ ਸਰਹੱਦ ਖੁੱਲ੍ਹੀ ਰੱਖੀ ਜਾਵੇ, ਪਰ ਇਸ ‘ਤੇ ਕੰਟਰੋਲ ਵੀ ਹੋਣਾ ਚਾਹੀਦਾ ਹੈ।

ਦਰਅਸਲ ਇਹ ਟਿੱਪਣੀ ਕਿਸਾਨ ਅੰਦੋਲਨ ਦੌਰਾਨ ਪ੍ਰਦਰਸ਼ਨ ਕਰ ਰਹੇ 22 ਸਾਲਾ ਨੌਜਵਾਨ ਦੀ ਮੌਤ ਦੀ ਨਿਆਂਇਕ ਜਾਂਚ ਦੇ ਹਾਈ ਕੋਰਟ ਦੇ ਹੁਕਮਾਂ ਵਿਰੁੱਧ ਹਰਿਆਣਾ ਸਰਕਾਰ ਵੱਲੋਂ ਦਾਇਰ ਪਟੀਸ਼ਨ ‘ਤੇ ਸੁਪਰੀਮ ਕੋਰਟ ‘ਚ ਸੁਣਵਾਈ ਦੌਰਾਨ ਕੀਤੀ ਗਈ। . ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ 10 ਜੁਲਾਈ ਨੂੰ ਸ਼ੰਭੂ ਬਾਰਡਰ ਖੋਲ੍ਹਣ ਦਾ ਹੁਕਮ ਦਿੱਤਾ ਸੀ। ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਨੇ ਹੁਕਮ ਜਾਰੀ ਕਰਦਿਆਂ ਕਿਹਾ ਸੀ ਕਿ ਸ਼ੰਭੂ ਸਰਹੱਦ ਨੂੰ ਇੱਕ ਹਫ਼ਤੇ ਦੇ ਅੰਦਰ ਅੰਦਰ ਬੈਰੀਕੇਡ ਹਟਾ ਕੇ ਖੋਲ੍ਹਿਆ ਜਾਵੇ।
