ਹਾਈਕੋਰਟ ਵੱਲੋਂ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਦਲੀਲ ਖਾਰਿਜ, 5994 ETT ਟੀਚਰਾਂ ਦੀ ਭਰਤੀ ‘ਤੇ ਰੋਕ ਹਟਾਉਣ ਤੋਂ ਇਨਕਾਰ
ਡੈਸਕ- ਪੰਜਾਬ-ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਵੱਲੋਂ ਪੰਜਾਬ ਵਿੱਚ ਈ.ਟੀ.ਟੀ. ਅਧਿਆਪਕਾਂ ਦੀਆਂ 5994 ਅਸਾਮੀਆਂ ‘ਤੇ ਭਰਤੀ ‘ਤੇ ਲੱਗੀ ਰੋਕ ਹਟਾਉਣ ਸਬੰਧੀ ਦਿੱਤੀ ਗਈ ਦਲੀਲ ਨਾਲ ਅਸਹਿਮਤੀ ਪ੍ਰਗਟਾਈ ਹੈ। ਹਾਈ ਕੋਰਟ ਨੇ ਸਟੇਅ ਜਾਰੀ ਰੱਖਦਿਆਂ ਹੁਣ ਸੁਣਵਾਈ 12 ਦਸੰਬਰ ਨੂੰ ਤੈਅ ਕੀਤੀ ਹੈ। ਇਸ਼ਤਿਹਾਰ ਜਾਰੀ ਹੋਣ ਤੋਂ ਬਾਅਦ ਹੁਣ ਇਹ ਭਰਤੀ ਨਿਯਮਾਂ ‘ਚ ਬਦਲਾਅ ਨੂੰ ਲੈ ਕੇ ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਸੰਵਿਧਾਨਕ ਬੈਂਚ ਦੇ ਫੈਸਲੇ ‘ਤੇ ਨਿਰਭਰ ਕਰੇਗੀ। ਪਿਛਲੀ ਸੁਣਵਾਈ ‘ਤੇ ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਹਾਈ ਕੋਰਟ ਨੂੰ ਭਰੋਸਾ ਦਿੱਤਾ ਸੀ ਕਿ ਅਗਲੇ ਹੁਕਮਾਂ ਤੱਕ ਭਰਤੀ ਨਹੀਂ ਵਧਾਈ ਜਾਵੇਗੀ।
ਪਟੀਸ਼ਨ ਦਾਇਰ ਕਰਦਿਆਂ ਪਰਵਿੰਦਰ ਸਿੰਘ ਅਤੇ ਹੋਰਨਾਂ ਨੇ ਐਡਵੋਕੇਟ ਵਿਕਾਸ ਚਤਰਥ ਰਾਹੀਂ ਹਾਈ ਕੋਰਟ ਨੂੰ ਦੱਸਿਆ ਕਿ ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ 12 ਅਕਤੂਬਰ 2022 ਨੂੰ ਈ.ਟੀ.ਟੀ ਦੀਆਂ 5994 ਅਸਾਮੀਆਂ ਲਈ ਇਸ਼ਤਿਹਾਰ ਜਾਰੀ ਕੀਤਾ ਸੀ। ਪਟੀਸ਼ਨਕਰਤਾਵਾਂ ਨੇ ਇਸ ਲਈ ਅਰਜ਼ੀ ਵੀ ਦਿੱਤੀ ਸੀ ਕਿਉਂਕਿ ਉਨ੍ਹਾਂ ਨੇ ਇਸ਼ਤਿਹਾਰ ਵਿੱਚ ਯੋਗਤਾ ਦੇ ਮਾਪਦੰਡ ਪੂਰੇ ਕੀਤੇ ਸਨ। 28 ਅਕਤੂਬਰ 2022 ਨੂੰ ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਪੰਜਾਬ ਸਿਵਲ ਸਰਵਿਸ ਰੂਲਜ਼ ਨੂੰ ਨੋਟੀਫਾਈ ਕੀਤਾ ਸੀ।
ਇਸ ਤਹਿਤ ਗਰੁੱਪ ਸੀ ਦੀਆਂ ਸਾਰੀਆਂ ਸਰਕਾਰੀ ਨੌਕਰੀਆਂ ਲਈ ਪੰਜਾਬੀ ਦੀ ਵਾਧੂ ਪ੍ਰੀਖਿਆ ਲਾਜ਼ਮੀ ਕਰ ਦਿੱਤੀ ਗਈ ਹੈ। ਨੋਟੀਫਿਕੇਸ਼ਨ ਜਾਰੀ ਕਰਦਿਆਂ ਰਾਖਵੇਂ ਵਰਗ ਨੂੰ ਕੋਈ ਢਿੱਲ ਨਹੀਂ ਦਿੱਤੀ ਗਈ। ਇਸ ਤੋਂ ਬਾਅਦ 1 ਦਸੰਬਰ 2022 ਨੂੰ ਇੱਕ ਸ਼ੁੱਧੀ ਪੱਤਰ ਜਾਰੀ ਕੀਤਾ ਗਿਆ ਸੀ, ਜਿਸ ਤਹਿਤ ਈ.ਟੀ.ਟੀ ਦੀਆਂ 5994 ਅਸਾਮੀਆਂ ਭਰਨ ਲਈ 12 ਅਕਤੂਬਰ ਨੂੰ ਜਾਰੀ ਇਸ਼ਤਿਹਾਰ ‘ਤੇ ਵੀ ਇਸ ਨੂੰ ਲਾਗੂ ਕੀਤਾ ਗਿਆ ਸੀ। ਪਟੀਸ਼ਨਰ ਨੇ ਕਿਹਾ ਕਿ ਇਸ ਨੋਟੀਫਿਕੇਸ਼ਨ ਨੂੰ ਕਿਸੇ ਵੀ ਪਹਿਲਾਂ ਜਾਰੀ ਕੀਤੀ ਗਈ ਭਰਤੀ ‘ਤੇ ਲਾਗੂ ਕਰਨਾ ਪੂਰੀ ਤਰ੍ਹਾਂ ਗਲਤ ਹੈ। ਅਜਿਹੀ ਸਥਿਤੀ ਵਿੱਚ ਇਸ ਸ਼ੁੱਧੀ ਪੱਤਰ ਨੂੰ ਰੱਦ ਕਰਨ ਦੇ ਹੁਕਮ ਦਿੱਤੇ ਜਾਣ ਅਤੇ ਭਰਤੀ ਪ੍ਰਕਿਰਿਆ ਨੂੰ ਵੀ ਰੋਕਿਆ ਜਾਵੇ।
ਹਾਈਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਇਸ ਪਟੀਸ਼ਨ ‘ਚ ਭਰਤੀ ਨੂੰ ਚੁਣੌਤੀ ਦੇਣ ਦਾ ਸਭ ਤੋਂ ਅਹਿਮ ਆਧਾਰ ਇਸ਼ਤਿਹਾਰ ਜਾਰੀ ਹੋਣ ਤੋਂ ਬਾਅਦ ਭਰਤੀ ਪ੍ਰਕਿਰਿਆ ‘ਚ ਬਦਲਾਅ ਹੈ। ਇਹ ਮੁੱਦਾ ਤੇਜ ਪ੍ਰਕਾਸ਼ ਬਨਾਮ ਰਾਜਸਥਾਨ ਸਰਕਾਰ ਕੇਸ ਦੇ ਰੂਪ ਵਿੱਚ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਪਹੁੰਚਿਆ। ਇਹ ਮਾਮਲਾ ਸੰਵਿਧਾਨਕ ਬੈਂਚ ਕੋਲ ਭੇਜਿਆ ਗਿਆ ਸੀ, ਜਿਸ ਨੇ ਇਸ ਵਿਸ਼ੇ ‘ਤੇ ਆਪਣਾ ਫੈਸਲਾ 18 ਜੁਲਾਈ, 2023 ਲਈ ਸੁਰੱਖਿਅਤ ਰੱਖ ਲਿਆ ਹੈ। ਹਾਈਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਸਾਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਫੈਸਲੇ ਦੀ ਉਡੀਕ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈ।
ਸੁਣਵਾਈ ਦੌਰਾਨ ਸਰਕਾਰ ਨੇ ਹਾਈਕੋਰਟ ਨੂੰ ਅਪੀਲ ਕੀਤੀ ਕਿ ਭਰਤੀ ਪ੍ਰਕਿਰਿਆ ਨੂੰ ਜਲਦੀ ਪੂਰਾ ਕਰਨ ਲਈ ਇਸ ਪਟੀਸ਼ਨ ਦਾ ਨਿਪਟਾਰਾ ਕੀਤਾ ਜਾਵੇ। ਸਰਕਾਰ ਨੇ ਕਿਹਾ ਕਿ ਭਰਤੀ ਨੂੰ ਪੂਰਾ ਕਰਕੇ ਸੂਬੇ ਦੇ ਉਨ੍ਹਾਂ ਸਕੂਲਾਂ ਵਿੱਚ ਅਧਿਆਪਕਾਂ ਦੀ ਘਾਟ ਪੂਰੀ ਕੀਤੀ ਜਾਵੇਗੀ, ਜਿੱਥੇ ਇਸ ਸਮੇਂ ਸਿਰਫ਼ ਇੱਕ ਅਧਿਆਪਕ ਹੀ ਸਕੂਲ ਚਲਾ ਰਿਹਾ ਹੈ। ਮਾਮਲਾ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਵਿਚਾਰ ਅਧੀਨ ਹੈ, ਪਰ ਫੈਸਲਾ ਆਉਣ ਤੱਕ ਹਾਈਕੋਰਟ ਅੰਤਰਿਮ ਹੁਕਮ ਜਾਰੀ ਕਰ ਸਕਦੀ ਹੈ।
