2004 ਤੋਂ ਪਹਿਲਾਂ ਨਿਯੁਕਤ ਮੁਲਾਜ਼ਮਾਂ ਦੀ ਪੈਨਸ਼ਨ ਨੂੰ ਲੈ ਕੇ ਹਾਈਕੋਰਟ ਨੇ ਸੁਣਾਇਆ ਵੱਡਾ ਫੈਸਲਾ
ਡੈਸਕ- ਪੰਜਾਬ-ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਨੇ ਇਕ ਅਹਿਮ ਫੈਸਲਾ ਦਿੰਦੇ ਹੋਏ ਸਪੱਸ਼ਟ ਕੀਤਾ ਹੈ ਕਿ ਜੇਕਰ ਕੋਈ ਕਰਮਚਾਰੀ 2004 ਤੋਂ ਪਹਿਲਾਂ ਨਿਯੁਕਤ ਕੀਤਾ ਗਿਆ ਸੀ, ਜੇ ਇਸ ਮਿਤੀ ਤੋਂ ਬਾਅਦ ਵੀ ਰੈਗੂਲਰ ਹੋ ਜਾਂਦਾ ਹੈ ਤਾਂ ਉਹ ਪੁਰਾਣੀ ਪੈਨਸ਼ਨ ਸਕੀਮ ਦਾ ਹੱਕਦਾਰ ਹੈ। ਪੰਜਾਬ ਦੇ ਵੱਖ-ਵੱਖ ਵਿਭਾਗਾਂ ਦੇ ਮੁਲਾਜ਼ਮਾਂ ਵੱਲੋਂ ਦਾਇਰ ਪਟੀਸ਼ਨਾਂ ਨੂੰ ਪ੍ਰਵਾਨ ਕਰਦਿਆਂ ਹਾਈ ਕੋਰਟ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ 4 ਮਹੀਨਿਆਂ ਦੇ ਅੰਦਰ-ਅੰਦਰ ਉਨ੍ਹਾਂ ਨੂੰ ਪੁਰਾਣੀ ਪੈਨਸ਼ਨ ਸਕੀਮ ਦਾ ਲਾਭ ਜਾਰੀ ਕਰਨ ਦੇ ਹੁਕਮ ਦਿੱਤੇ ਹਨ।
ਪਟੀਸ਼ਨ ਦਾਇਰ ਕਰਦਿਆਂ ਸੁਰਜੀਤ ਸਿੰਘ ਤੇ ਹੋਰਨਾਂ ਨੇ ਐਡਵੋਕੇਟ ਰੰਜੀਵਨ ਸਿੰਘ ਰਾਹੀਂ ਹਾਈ ਕੋਰਟ ਨੂੰ ਦੱਸਿਆ ਕਿ ਉਨ੍ਹਾਂ ਨੂੰ ਪੰਜਾਬ ਦੇ ਵੱਖ-ਵੱਖ ਵਿਭਾਗਾਂ, ਬੋਰਡਾਂ, ਕਾਰਪੋਰੇਸ਼ਨਾਂ ਆਦਿ ਵਿੱਚ ਕੱਚੇ ਮੁਲਾਜ਼ਮਾਂ ਵਜੋਂ ਨਿਯੁਕਤ ਕੀਤਾ ਗਿਆ ਹੈ। ਉਨ੍ਹਾਂ ਦੀ ਨਿਯੁਕਤੀ 2004 ਤੋਂ ਪਹਿਲਾਂ ਕੀਤੀ ਗਈ ਸੀ ਪਰ 2004 ਤੋਂ ਬਾਅਦ ਰੈਗੂਲਰ ਕਰ ਦਿੱਤਾ ਗਿਆ।
ਪਟੀਸ਼ਨਰ ਨੇ ਕਿਹਾ ਕਿ ਰਾਜਾਂ ਨੇ 2004 ਤੋਂ ਬਾਅਦ ਨਿਯੁਕਤ ਮੁਲਾਜ਼ਮਾਂ ਲਈ ਨਵੀਂ ਪੈਨਸ਼ਨ ਸਕੀਮ ਅਪਣਾਈ ਸੀ ਅਤੇ ਪਟੀਸ਼ਨਕਰਤਾਵਾਂ ਨੂੰ ਵੀ ਇਸੇ ਸਕੀਮ ਨੂੰ ਅਪਣਾਉਣ ਦੀ ਸ਼ਰਤ ‘ਤੇ ਰੈਗੂਲਰ ਕੀਤਾ ਗਿਆ ਸੀ। ਰੈਗੂਲਰ ਹੋਣ ਤੋਂ ਬਾਅਦ ਪਟੀਸ਼ਨਰਾਂ ਨੇ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕਰਕੇ ਪੁਰਾਣੀ ਪੈਨਸ਼ਨ ਸਕੀਮ ਦਾ ਲਾਭ ਦੇਣ ਲਈ ਹਦਾਇਤਾਂ ਜਾਰੀ ਕਰਨ ਦੀ ਅਪੀਲ ਕੀਤੀ ਸੀ। ਹਾਈ ਕੋਰਟ ਨੇ ਜਨਵਰੀ 2023 ਵਿੱਚ ਪਟੀਸ਼ਨਾਂ ਦਾ ਨਿਪਟਾਰਾ ਕਰਦਿਆਂ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਫੈਸਲਾ ਲੈਣ ਦੇ ਹੁਕਮ ਦਿੱਤੇ ਸਨ। ਇਸ ਤੋਂ ਬਾਅਦ ਸਰਕਾਰ ਵੱਲੋਂ ਇਸ ਦਾਅਵੇ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ ਗਿਆ।
ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਤਰਫੋਂ ਦਲੀਲ ਦਿੱਤੀ ਗਈ ਸੀ ਕਿ ਪਟੀਸ਼ਨਰਾਂ ਨੂੰ ਰੈਗੂਲਰ ਕਰਨ ਵੇਲੇ ਨਿਯਮ ਤੇ ਸ਼ਰਤਾਂ ਰੱਖੀਆਂ ਗਈਆਂ ਸਨ ਅਤੇ ਇਨ੍ਹਾਂ ਸ਼ਰਤਾਂ ਨੂੰ ਪੜ੍ਹ ਤੇ ਅਪਣਾਉਣ ਮਗਰੋਂ ਉਹ ਇਨਕਾਰ ਨਹੀਂ ਕਰ ਸਕਦੇ। ਹਾਈਕੋਰਟ ਨੇ ਸਾਰੀਆਂ ਧਿਰਾਂ ਨੂੰ ਸੁਣਨ ਤੋਂ ਬਾਅਦ ਕਿਹਾ ਕਿ ਹਰਬੰਸ ਲਾਲ ਅਤੇ ਹੋਰਾਂ ਦੇ ਮਾਮਲੇ ‘ਚ ਹਾਈਕੋਰਟ ਨੇ ਪੈਨਸ਼ਨ ਸਬੰਧੀ ਸਥਿਤੀ ਸਪੱਸ਼ਟ ਕੀਤੀ ਹੈ | ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਅਪੀਲ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਰੱਦ ਕਰ ਦਿੱਤੀ ਗਈ ਹੈ।
ਅਦਾਲਤ ਨੇ ਕਿਹਾ ਕਿ ਅਜਿਹੀ ਸਥਿਤੀ ਵਿੱਚ ਜਦੋਂ ਪੰਜਾਬ ਸਰਕਾਰ ਵੱਲੋਂ ਕਿਸੇ ਫੈਸਲੇ ਨੂੰ ਪ੍ਰਵਾਨ ਕਰ ਲਿਆ ਗਿਆ ਹੈ ਤਾਂ ਉਸ ਦੀ ਹਰ ਹਾਲਤ ਵਿੱਚ ਪਾਲਣਾ ਕੀਤੀ ਜਾਣੀ ਚਾਹੀਦੀ ਹੈ। ਸਰਕਾਰ ਮੁਲਾਜ਼ਮਾਂ ਨੂੰ ਅਦਾਲਤ ਵਿੱਚ ਜਾਣ ਲਈ ਮਜਬੂਰ ਨਾ ਕਰੇ। ਇਨ੍ਹਾਂ ਟਿੱਪਣੀਆਂ ਦੇ ਨਾਲ ਹੀ ਹਾਈ ਕੋਰਟ ਨੇ ਪਟੀਸ਼ਨਾਂ ਨੂੰ ਪ੍ਰਵਾਨ ਕਰਦਿਆਂ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ 4 ਮਹੀਨਿਆਂ ਦੇ ਅੰਦਰ ਸਾਰੇ ਪਟੀਸ਼ਨਰਾਂ ਨੂੰ ਪੁਰਾਣੀ ਪੈਨਸ਼ਨ ਦੇ ਲਾਭ ਜਾਰੀ ਕਰਨ ਦੇ ਹੁਕਮ ਦਿੱਤੇ ਹਨ।
