ਛੱਤੀਸਗੜ੍ਹ- ਛੱਤੀਸਗੜ੍ਹ ਹਾਈਕੋਰਟ ਨੇ ਔਰਤ ਦੇ ਦੁਬਾਰਾ ਵਿਆਹ ਸਬੰਧੀ ਮਹੱਤਵਪੂਰਨ ਫ਼ੈਸਲਾ ਸੁਣਾਇਆ ਹੈ। ਹਾਈ ਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਪਤੀ ਦੀ ਮੌਤ ਤੋਂ ਬਾਅਦ ਜੇਕਰ ਕੋਈ ਔਰਤ ਦੁਬਾਰਾ ਵਿਆਹ ਕਰਵਾਉਂਦੀ ਹੈ ਤਾਂ ਇਹ ਪੂਰੀ ਤਰ੍ਹਾਂ ਸਾਬਿਤ ਹੋ ਜਾਂਦਾ ਹੈ ਕਿ ਮਰਹੂਮ ਪਤੀ ਦੀ ਜਾਇਦਾਦ ਤੋਂ ਉਸ ਦਾ ਹੱਕ ਖ਼ਤਮ ਹੋ ਜਾਵੇਗਾ।
ਹਾਈ ਕੋਰਟ ਦੇ ਜੱਜ ਸੰਜੇ ਅਗਰਵਾਲ ਨੇ 28 ਜੂਨ ਨੂੰ ਪਟੀਸ਼ਨਰ ਲੋਕਨਾਥ ਦੀ ਵਿਧਵਾ ਕੀਆ ਬਾਈ ਖਿਲਾਫ ਦਾਇਰ ਜਾਇਦਾਦ ਦੇ ਮੁਕੱਦਮੇ ਨਾਲ ਸਬੰਧਤ ਇਕ ਅਪੀਲ ਖਾਰਜ ਕਰ ਦਿੱਤੀ। ਅਪੀਲ ‘ਚ ਦਾਅਵਾ ਕੀਤਾ ਗਿਆ ਸੀ ਕਿ ਵਿਧਵਾ ਨੇ ਸਥਾਨਕ ਰੀਤੀ-ਰਿਵਾਜਾਂ ਨਾਲ ਦੁਬਾਰਾ ਵਿਆਹ ਕਰਵਾਇਆ ਸੀ। ਅਪੀਲਕਰਤਾ ਲੋਕਨਾਥ ਕੀਆ ਬਾਈ ਦੇ ਪਤੀ ਦਾ ਚਚੇਰਾ ਭਰਾ ਹੈ। ਹੁਕਮ ਵਿਚ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਹਿੰਦੂ ਵਿਧਵਾ ਪੁਨਰਵਿਆਹ ਐਕਟ 1856 ਦੀ ਧਾਰਾ 6 ਅਨੁਸਾਰ ਦੁਬਾਰਾ ਵਿਆਹ ਦੇ ਮਾਮਲੇ ‘ਚ ਵਿਆਹ ਲਈ ਸਾਰੀ ਕਾਗਜ਼ੀ ਕਾਰਵਾਈ ਨੂੰ ਸਾਬਿਤ ਕਰਨਾ ਜ਼ਰੂਰੀ ਹੈ। ਹੁਕਮ ਅਨੁਸਾਰ ਇਹ ਵਿਵਾਦ ਕੀਆ ਬਾਈ ਦੇ ਪਤੀ ਘਾਸੀ ਦੀ ਜਾਇਦਾਦੇ ਹਿੱਸੇ ਨਾਲ ਸੰਬੰਧਤ ਹੈ। ਘਾਸੀ ਦੀ ਸਾਲ 1942 ‘ਚ ਮੌਤ ਹੋ ਗਈ ਸੀ। ਵਿਵਾਦ ਜਾਇਦਾਦ ਮੂਲ ਰੂਪ ‘ਚ ਸੁਗ੍ਰੀਵ ਨਾਂ ਦੇ ਵਿਅਕਤੀ ਦੀ ਸੀ ਜਿਨ੍ਹਾਂ ਦੇ ਚਾਰ ਪੁੱਤਰ ਮੋਹਨ, ਅਭਿਰਾਮ, ਗੋਵਰਧਨ ਤੇ ਜੀਵਨਧਨ ਸਨ। ਸਾਰਿਆਂ ਦੀ ਮੌਤ ਹੋ ਚੁੱਕੀ ਹੈ। ਗੋਵਰਧਨ ਦਾ ਇਕ ਪੁੱਤਰ ਲੋਕਨਾਥ ਇਸ ਮਾਮਲੇ ‘ਚ ਵਾਦੀ ਸੀ ਜਦਕਿ ਘਾਸੀ, ਅਭਿਰਾਮ ਦਾ ਪੁੱਤਰ ਸੀ।
ਚੂੜੀ ਪ੍ਰਥਾ ਜ਼ਰੀਏ ਕਰਵਾਇਆ ਸੀ ਦੂਸਰਾ ਵਿਆਹ
ਲੋਕਨਾਥ, ਜੋ ਹੁਣ ਜੀਵਤ ਨਹੀਂ ਹੈ, ਨੇ ਇਹ ਦਾਅਵਾ ਕਰਦੇ ਹੋਏ ਅਦਾਲਤ ਦੀ ਪਨਾਹ ਲਈ ਸੀ ਕਿ ਕੀਆ ਬਾਈ ਨੇ ਆਪਣੇ ਪਤੀ ਦੀ ਮੌਤ ਤੋਂ ਬਾਅਦ ਸਾਲ 1954-55 ‘ਚ ਚੂੜੀ ਪ੍ਰਥਾ ਜ਼ਰੀਏ ਦੂਸਰਾ ਵਿਆਹ ਕੀਤਾ ਸੀ ਤੇ ਇਸ ਲਈ ਉਸ ਨੂੰ ਤੇ ਉਸ ਦੀ ਬੇਟੀ ਸਿੰਧੂ ਨੂੰ ਜਾਇਦਾਦ ‘ਚ ਕੋਈ ਹਿੱਸਾ ਨਹੀਂ ਮਿਲ ਸਕਦਾ।
