ਹਾਈਕੋਰਟ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਲਗਾਇਆ 50 ਹਜ਼ਾਰ ਦਾ ਜ਼ੁਰਮਾਨਾ , ਲਗਾਈ ਝਾੜ
ਡੈਸਕ- ਪੰਜਾਬ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਭਰਤੀ ਪ੍ਰਕਿਰਿਆ ਪੂਰੀ ਹੋਣ ਤੋਂ ਬਾਅਦ ਨਿਯਮਾਂ ‘ਚ ਕੀਤੀ ਗਈ ਸੋਧ ‘ਤੇ ਪੰਜਾਬ ਸਰਕਾਰ ਦੇ ਗੈਰ-ਜ਼ਿੰਮੇਵਾਰਾਨਾ ਰਵੱਈਏ ਨੂੰ ਗੈਰ-ਕਾਨੂੰਨੀ ਕਰਾਰ ਦਿੰਦੇ ਹੋਏ 50,000 ਰੁਪਏ ਦਾ ਜੁਰਮਾਨਾ ਲਗਾਇਆ ਹੈ।
ਹਾਈ ਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਅਜਿਹਾ ਫੈਸਲਾ ਕਾਨੂੰਨ ਦੇ ਸ਼ਾਸਨ ਲਈ ਸਰਾਪ ਹੈ ਅਤੇ ਸੰਵਿਧਾਨ ਦੀ ਧਾਰਾ 14 ਦੀ ਵੀ ਉਲੰਘਣਾ ਹੈ। ਇਨ੍ਹਾਂ ਟਿੱਪਣੀਆਂ ਨਾਲ ਹਾਈ ਕੋਰਟ ਨੇ ਯੋਗਤਾ ਪ੍ਰੀਖਿਆ ਦੀ ਸ਼ਰਤ ਨੂੰ ਖਤਮ ਕਰਨ ਦੇ ਹੁਕਮਾਂ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ ਹੈ ਅਤੇ ਯੋਗਤਾ ਪ੍ਰੀਖਿਆ ਪਾਸ ਕਰਨ ਵਾਲੇ ਬਿਨੈਕਾਰਾਂ ਦਾ ਹੀ ਨਤੀਜਾ ਜਾਰੀ ਕਰਨ ਦੇ ਹੁਕਮ ਦਿੱਤੇ ਹਨ।
ਪਟੀਸ਼ਨ ਦਾਇਰ ਕਰਦਿਆਂ ਅਮਨਦੀਪ ਸਿੰਘ ਅਤੇ ਹੋਰਨਾਂ ਨੇ ਹਾਈ ਕੋਰਟ ਨੂੰ ਦੱਸਿਆ ਸੀ ਕਿ ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਸਰੀਰਕ ਸਿੱਖਿਆ ਅਧਿਆਪਕਾਂ ਦੀਆਂ 168 ਅਸਾਮੀਆਂ ਲਈ ਭਰਤੀ ਦਾ ਐਲਾਨ ਕੀਤਾ ਹੈ। ਇਸ ਦੇ ਇਸ਼ਤਿਹਾਰ ਵਿੱਚ, ਬਿਨੈਕਾਰਾਂ ਲਈ ਪੰਜਾਬ ਰਾਜ ਅਧਿਆਪਕ ਯੋਗਤਾ ਟੈਸਟ (ਪੀਐਸਟੀਈਟੀ) ਪਾਸ ਕਰਨਾ ਲਾਜ਼ਮੀ ਸੀ।
ਇਸ ਤੋਂ ਬਾਅਦ, ਜਦੋਂ ਭਰਤੀ ਪ੍ਰਕਿਰਿਆ ਪੂਰੀ ਹੋ ਗਈ ਸੀ ਅਤੇ ਸਿਰਫ ਅੰਤਿਮ ਨਤੀਜਾ ਜਾਰੀ ਕਰਨਾ ਬਾਕੀ ਸੀ ਤਾਂ 26 ਅਗਸਤ 2023 ਨੂੰ ਨਿਯਮਾਂ ਵਿੱਚ ਸੋਧ ਕਰ ਦਿੱਤੀ ਗਈ ਅਤੇ ਯੋਗਤਾ ਪ੍ਰੀਖਿਆ ਦੀ ਜ਼ਰੂਰਤ ਨੂੰ ਖਤਮ ਕਰ ਦਿੱਤਾ ਗਿਆ ਸੀ। ਹਾਈਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਪੰਜਾਬ ਸਰਕਾਰ ਦਾ ਹੁਕਮ ਨਿੰਦਣਯੋਗ ਹੈ ਅਤੇ ਸੂਬੇ ਨੇ ਗੈਰ-ਜ਼ਿੰਮੇਵਾਰਾਨਾ ਕੰਮ ਕੀਤਾ ਹੈ ਅਤੇ ਬੇਲੋੜੇ ਮੁਕੱਦਮੇਬਾਜ਼ੀ ਕੀਤੀ ਹੈ।
ਇਸ਼ਤਿਹਾਰ 8 ਜਨਵਰੀ, 2022 ਨੂੰ ਜਾਰੀ ਕੀਤਾ ਗਿਆ ਸੀ ਅਤੇ ਨਤੀਜਾ 6 ਅਕਤੂਬਰ, 2022 ਨੂੰ ਘੋਸ਼ਿਤ ਕੀਤਾ ਗਿਆ ਸੀ। ਦਸਤਾਵੇਜ਼ਾਂ ਦੀ ਪੜਤਾਲ 19 ਦਸੰਬਰ, 2022 ਨੂੰ ਪੂਰੀ ਹੋ ਗਈ ਸੀ ਪਰ ਰਾਜ ਨੇ ਨਤੀਜਾ ਘੋਸ਼ਿਤ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਇਸ਼ਤਿਹਾਰ ਵਿੱਚ ਕੋਈ ਸੁਧਾਰ ਨਹੀਂ ਕੀਤਾ ਜਾਂ ਸ਼ੁਧਤਾ ਜਾਰੀ ਨਹੀਂ ਕੀਤੀ।
26 ਅਗਸਤ, 2023 ਦੇ ਸੁਧਾਈ-ਕਮ-ਪਬਲਿਕ ਨੋਟਿਸ ਰਾਹੀਂ ਨਿਯਮ ਨੂੰ ਬਦਲਣ ਦੀ ਕੋਸ਼ਿਸ਼ ਗੈਰ-ਕਾਨੂੰਨੀ ਹੈ। ਹਾਈਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਇਹ ਇਕ ਤੈਅਸ਼ੁਦਾ ਸਿਧਾਂਤ ਹੈ ਕਿ ਖੇਡ ਸ਼ੁਰੂ ਹੋਣ ਤੋਂ ਬਾਅਦ ਨਿਯਮਾਂ ਨੂੰ ਬਦਲਿਆ ਨਹੀਂ ਜਾ ਸਕਦਾ।
ਜਿਨ੍ਹਾਂ ਨੇ ਯੋਗਤਾ ਪ੍ਰੀਖਿਆ ਪਾਸ ਨਹੀਂ ਕੀਤੀ, ਉਨ੍ਹਾਂ ਨੇ ਅਯੋਗ ਹੋਣ ਦੇ ਬਾਵਜੂਦ ਭਰਤੀ ਲਈ ਅਪਲਾਈ ਕੀਤਾ ਅਤੇ ਪੀ.ਐੱਸ.ਟੀ.ਈ.ਟੀ. ਪਾਸ ਕਰਨ ਦੀ ਸ਼ਰਤ ਨੂੰ ਹਟਾਉਣ ਲਈ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਦਰਖਾਸਤ ਦਿੱਤੀ। ਇਸ ਮਾਮਲੇ ਦੀ ਜਾਂਚ ਲਈ ਸਰਕਾਰ ਵੱਲੋਂ ਬਣਾਈ ਗਈ ਕਮੇਟੀ ਨੇ ਪਾਇਆ ਕਿ ਸਰੀਰਕ ਸਿੱਖਿਆ ਮਾਸਟਰਾਂ ਦੀ ਭਰਤੀ ਲਈ ਯੋਗਤਾ PSTET ਲਾਜ਼ਮੀ ਨਹੀਂ ਹੈ।
ਇਸ ਤੋਂ ਬਾਅਦ ਜਨਤਕ ਨੋਟਿਸ-ਕਮ-ਸ਼ੁੱਧੀ ਪੱਤਰ ਜਾਰੀ ਕਰਨ ਦੀਆਂ ਹਦਾਇਤਾਂ ਦਿੱਤੀਆਂ ਗਈਆਂ। ਹਾਈਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਅਜਿਹਾ ਕਰਨ ਨਾਲ ਸਿੱਧੇ ਤੌਰ ‘ਤੇ ਉਨ੍ਹਾਂ ਚੁਣੇ ਹੋਏ ਲੋਕਾਂ ਦੀ ਮਦਦ ਹੋ ਰਹੀ ਹੈ ਜੋ ਇਸ਼ਤਿਹਾਰ ਦੇ ਮੁਤਾਬਕ ਯੋਗ ਨਹੀਂ ਸਨ।
