ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ‘ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ’ ਨੂੰ ਕੀਤਾ ਬਹਾਲ
ਡੈਸਕ- ਭਾਰਤ ਦੀ ਸਰਬਉੱਚ ਅਦਾਲਤ ਨੇ ਅੱਜ ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ ਨੂੰ ਬਹਾਲ ਕਰਦਿਆਂ ‘ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ ਐਕਟ-2016’ ਨੂੰ ਲਾਗੂ ਕਰ ਕੇ ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ (ਰੀਪੀਲ) ਐਕਟ-2017 ਨੂੰ ‘ਗ਼ੈਰ-ਸੰਵਿਧਾਨਕ’ ਐਲਾਨ ਦਿਤਾ। ਜਸਟਿਸ ਬੀ.ਆਰ. ਗਵਈ ਅਤੇ ਜਸਟਿਸ ਕੇ.ਵੀ. ਵਿਸ਼ਵਨਾਥਨ ਦੀ ਦੋ ਬੈਂਚਾਂ ਵਾਲੀ ਅਦਾਲਤ ਵਲੋਂ 65 ਪੰਨਿਆਂ ਦੇ ਫ਼ੈਸਲੇ ’ਚ ’ਵਰਸਿਟੀ ਨੂੰ ਸੁਰਜੀਤ ਕਰਦਿਆਂ ਖ਼ਾਲਸਾ ਕਾਲਜ ਗਵਰਨਿੰਗ ਕੌਂਸਲ ਵਲੋਂ ਯੂਨੀਵਰਸਿਟੀ ਦੀ ਬਹਾਲੀ ਦੇ ਲਏ ਪੱਖ ਨੂੰ ਸਹੀ ਕਰਾਰ ਦਿਤਾ।
ਕੌਂਸਲ ਨੇ ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ, ਚੰਡੀਗੜ੍ਹ ਦੇ 1 ਨਵੰਬਰ 2017 ਦੇ ਫ਼ੈਸਲੇ ਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ’ਚ ਚੁਣੌਤੀ ਦਿਤੀ ਸੀ, ਜਿਸ ਵਿਚ ਮੈਨੇਜਮੈਂਟ ਨੂੰ ਯੂਨੀਵਰਸਿਟੀ ਦੀ ਬਹਾਲੀ ਲਈ ਰਾਹਤ ਮਿਲੀ ਹੈ। ਅਦਾਲਤ ਨੇ ਹਾਈ ਕੋਰਟ ਦੇ ਹੁਕਮਾਂ ਨੂੰ ਰੱਦ ਕਰਦਿਆਂ ਰੀਪੀਲ ਐਕਟ ਤੋਂ ਪਹਿਲਾਂ ਬਣਾਏ ਗਏ ਵਿਧਾਨ ਸਭਾ ਦੇ 2015 ਦੇ ਐਕਟ ਨੂੰ ਸਹੀ ਠਹਿਰਾਇਆ। ਜ਼ਿਕਰਯੋਗ ਹੈ ਕਿ ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ ਦੀ ਸਥਾਪਨਾ ਉਸ ਸਮੇਂ ਦੀ ਅਕਾਲੀ-ਭਾਜਪਾ ਸਰਕਾਰ ਨੇ 2016 ’ਚ ਕੀਤੀ ਸੀ ਪਰ ਜਦੋਂ ਅਗਲੇ ਸਾਲ-2017 ’ਚ ਸਰਕਾਰ ਬਦਲੀ ਤਾਂ ਕੈਪਟਨ ਅਮਰਿੰਦਰ ਸਿੰਘ ਨੇ ਸਹੁੰ ਚੁਕਦਿਆਂ ਹੀ ਆਰਡੀਨੈਂਸ ਜਾਰੀ ਕਰਦਿਆਂ ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ ਨੂੰ ਖ਼ਤਮ ਕਰ ਦਿਤਾ।
ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਅਪਣੀ 10 ਸਤੰਬਰ 2024 ਨੂੰ ਸੁਣਵਾਈ ਦੌਰਾਨ ਵੇਖਿਆ ਕਿ ‘ਜੇਕਰ ਇਕ ਸਿਆਸੀ ਪਾਰਟੀ ਸੱਤਾ ’ਚ ਆਉਂਦੀ ਹੈ ਅਤੇ ਯੂਨੀਵਰਸਿਟੀ ਲਈ ਕਾਨੂੰਨ ਲਿਆਉਂਦੀ ਹੈ ਤੇ ਕੋਈ ਹੋਰ ਸਿਆਸੀ ਪਾਰਟੀ ਸੱਤਾ ’ਚ ਆਉਣ ’ਤੇ ਉਸ ਨੂੰ ਰੱਦ ਕਰ ਦਿੰਦੀ ਹੈ ਤਾਂ ਕੀ ਇਹ ਸਮਾਜ ਵਿਚ ਬੇਯਕੀਨੀ ਦਾ ਮਾਹੌਲ ਨਹੀਂ ਸਿਰਜੇਗੀ।’
ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ ਮੈਨੇਜਮੈਂਟ ਵਲੋਂ ਪੇਸ਼ ਹੋਏ ਸੀਨੀਅਰ ਵਕੀਲਾਂ ਨੇ ਪੱਖ ਪੇਸ਼ ਕਰਦਿਆਂ ਕਿਹਾ ਕਿ ‘ਰੀਪੀਲਸ ਐਕਟ’ ਸਰਕਾਰ ਦਾ ਇਕ ਤਰ੍ਹਾਂ ਦਾ ‘ਮਨਮਾਨੀ’ ਵਾਲਾ ਫ਼ੈਸਲਾ ਸੀ ਅਤੇ ਇਸ ਵਿਚ ਸੰਵਿਧਾਨ ਦੀ ਧਾਰਾ 14 ਦੀ ਘੋਰ ਉਲੰਘਣਾ ਹੋਈ ਹੈ, ਕਿਉਂਕਿ ਕਾਨੂੰਨ ਸਾਹਮਣੇ ਸੱਭ ਬਰਾਬਰ ਹਨ। ਉਨ੍ਹਾਂ ਇਹ ਵੀ ਕਿਹਾ ਕਿ ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਨਾਲ 1892 ਦੀ ਬਣੀ ਖ਼ਾਲਸਾ ਕਾਲਜ ਦੀ ਵਿਰਾਸਤੀ ਇਮਾਰਤ ਨੂੰ ਪ੍ਰਭਾਵਤ ਨਹੀਂ ਕਰੇਗੀ, ਕਿਉਂਕਿ ਯੂਨੀਵਰਸਿਟੀ ਦੀ ਹੋਂਦ ਖ਼ਾਲਸਾ ਕਾਲਜ ਤੋਂ ਅਲੱਗ ਹੈ।
ਇਸ ਸਬੰਧੀ ਕੌਂਸਲ ਦੇ ਆਨਰੇਰੀ ਸਕੱਤਰ ਰਜਿੰਦਰ ਮੋਹਨ ਸਿੰਘ ਛੀਨਾ ਨੇ ਕਿਹਾ ਕਿ ਉਸ ਸਮੇਂ ਦੀ ਪੰਜਾਬ ਸਰਕਾਰ ਦੇ ਮਨਮਾਨੇ ਫ਼ੈਸਲੇ ਨੂੰ ਮੈਨੇਜਮੈਂਟ ਵਲੋਂ ਪੰਜਾਬ-ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ’ਚ ਚੁਣੌਤੀ ਦਿਤੀ ਗਈ ਪਰ ਇਸ ਪਟੀਸ਼ਨ ਨੂੰ ਖ਼ਾਰਜ ਕਰ ਦਿਤਾ ਗਿਆ ਤੇ ਇਸ ਤਰ੍ਹਾਂ ਖ਼ਾਲਸਾ ਯੂਨੀਵਰਸਿਟੀ ਦੀ ਮੈਨੇਜਮੈਂਟ ਨੇ ਸਰਕਾਰ ਦੇ ਫ਼ੈਸਲਿਆਂ ਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ’ਚ ਚੁਣੌਤੀ ਦਿਤੀ ਅਤੇ ਹੁਣ 7 ਸਾਲ ਤੋਂ ਵੱਧ ਦੀ ਲੰਮੀ ਲੜਾਈ ਤੋਂ ਬਾਅਦ ਮੈਨੇਜਮੈਂਟ ਨੂੰ ਵੱਡੀ ਰਾਹਤ ਮਿਲੀ ਹੈ। ਇਸ ਮੌਕੇ ਖ਼ਾਲਸਾ ਕਾਲਜ ਮੈਨੇਜਮੈਂਟ ਵਲੋਂ 2025-26 ਅਕਾਦਮਿਕ ਸੈਸ਼ਨ ਲਈ ਕਲਾਸਾਂ ਸ਼ੁਰੂ ਕਰਨ ਦਾ ਐਲਾਨ ਵੀ ਕਰ ਦਿਤਾ ਗਿਆ ਹੈ।
